Can you cross the US border with cannabis?

The short answer is no, and it is not a grey area.

It is illegal to take cannabis across the Canada, US border in any form and in either direction, whether you are leaving Canada or coming back. That holds true even if you are heading to a US state where cannabis is legal, even if it is CBD rather than dried flower, even with a medical document, and even for a tiny amount for personal use.

Cannabis is legal in Canada. The border is a different world. Crossing it with cannabis is a federal crime, and the penalties are serious. Why the border is different

Inside Canada, the Cannabis Act makes adult use legal. The United States has not legalized cannabis at the federal level. It is still a controlled substance under US law, no matter what any individual state has decided. International borders are governed by federal law, and US Customs and Border Protection enforces those federal rules. So even a flight from Toronto to a state with legal dispensaries still crosses a federal line where cannabis is banned.

The same applies coming home. The Canada Border Services Agency also treats bringing cannabis across the border into Canada as an offence, with its own penalties.

The exceptions that aren’t

• A legal US state. It makes no difference. The border is federal, so the state’s rules don’t apply there.
• CBD. Products containing CBD are treated the same as other cannabis products at the border.
• Edibles, oils, topicals, vapes, and seeds. All of them count as cannabis products.
• A medical prescription. There is no medical exception at the US border.

What can actually happen

Arriving at a US port of entry with cannabis can lead to it being seized, along with fines, arrest, and prosecution. It can also affect your admissibility. Border officers can refuse you entry, and a cannabis-related record or admission can keep you out of the United States, sometimes long-term and only reversible with a formal and costly waiver. People who work or invest in the legal cannabis industry have also run into admissibility problems at the border.

On the way back, the Canada Border Services Agency can seize the cannabis and issue penalties for bringing it into the country.

If a border officer asks about cannabis

Officers can ask questions, including about cannabis use. Two things are worth knowing. Lying to a border officer is itself a serious offence, and admissions about cannabis can affect whether you are allowed in. This is genuinely tricky ground, and it is not something to wing. The safe move

Keep it simple. Never carry cannabis, CBD, or anything containing either across the border, in your bag, your car, or the mail. Using cannabis legally in Canada is your business at home. At the border, the only safe amount is none.
