Cannabis laws in Canada: the complete 2026 guide

Cannabis has been legal for adults across Canada since the Cannabis Act took effect in October 2018. But legal doesn’t mean identical. The federal government sets a baseline, and every province and territory builds its own rules on top. The national picture first, then where to find the rules that apply to you.

The federal baseline

Under the Cannabis Act, adults of legal age can:

• Possess up to 30 grams of legal dried cannabis (or equivalent) in public
• Share up to 30 grams with other adults (but never sell it, or give any to a minor)
• Buy from a provincially authorized retailer
• Grow up to 4 plants per residence (where the province allows it)
• Make cannabis products like edibles at home for personal use

These are federal floors. Provinces can, and do, make rules stricter.

Where the provinces differ

Four things vary by province:

1. Legal age: 18 in Alberta, 21 in Quebec, 19 almost everywhere else.
2. Where you buy: government stores, private retailers, or a mix.
3. Where you can consume: public-use rules range from permissive to near-total bans.
4. Home growing: Quebec and Manitoba ban it outright, despite the federal allowance.

The single most common mistake is assuming the rules from one province apply in another. They don’t. Always check the province you’re actually in.
